This Privacy Policy describes the privacy practices of the Mariner family of companies, including Mariner, LLC, Mariner Specialty Tax Services, LLC, Mariner Trust Company, LLC, Mariner Insurance Resources, LLC, Mariner Platform Solutions, LLC and MSEC, LLC (collectively, “Mariner”, “we”, “us”, or “our”) and how we collect, use and share your Personal Information if you:

  • use our websites at www.mariner.com, www.JoinMariner.com, www.marineradvisornetwork.com or our other digital properties that link to this Privacy Policy (collectively, the “Site”);
  • use our services or are eligible to access them as an employee benefit (“Client Services”);
  • visit our physical locations;
  • interact with us in a business-to-business capacity;
  • participate in our events, consumer research or other activities where this Privacy Policy is posted;
  • receive our marketing communications, engage with us on social media, or interact with us through other activities described in this Privacy Policy.

We refer to the Site, the Client Services and other activities described above, collectively, as the “Service”. In some cases, we may provide a different privacy policy for a particular event, digital property, or service, in which case that privacy policy will supersede this Policy and apply in accordance with its terms.

GLBA Consumer Financial Notice: For Personal Information that we handle pursuant to the federal Gramm-Leach-Bliley Act (“GLBA”), please see the GLBA Privacy Notice.

Mariner’s collection and use of your Personal Information for investment advisory, wealth management, financial planning, tax, estate planning and other related financial services on your behalf for your personal benefit is generally governed by the GLBA, the California Financial Information Privacy Act (“CalFIPA”), and/or the Fair Credit Reporting Act (“FCRA”). For all information not provided for financial purposes and governed by the GLBA, this notice outlines Mariner’s comprehensive compliance framework.

Mariner may use artificial intelligence to process your Personal Information, including to deploy artificial intelligence (“AI”) systems. Where AI is leveraged, it will only be used where legally permissible, in compliance with this Privacy Policy, and in a manner which is consistent with our commitments and values.  Mariner uses agentic AI tools to facilitate automated workflows across its systems, but Mariner does not use AI to engage in automated decision-making about financial advice based on your Personal Information, nor do we use AI to make employment decisions.

Definitions

Affiliates. Companies related by common ownership or control. They can be financial and nonfinancial companies.

Customer. Any natural person who receives or has received Services from Mariner for personal, family, or household purposes and has or had a continuing relationship with Mariner.

Customer Information. Personal Information as defined under applicable federal and state privacy laws, including information pertaining to Mariner’s own Customers as well as individuals who are or were customers of other financial institutions, where such information has been received by Mariner in the course of providing Services or through a servicing relationship, account transfer, acquisition, or similar arrangement.

Nonaffiliates. Companies not related by common ownership or control. They can be financial and nonfinancial companies.

Personal Information. Any data that can directly identify, contact, or locate a specific individual, or be combined with other data to do so.

Personal Information Provided

In the normal course of business, such as when you open an account, direct us to buy securities, seek advice about your investments, or enter into a contract, we typically obtain Personal Information about our prospective and current Customers, which may include but is not limited to:

  • Identifiers such as your name, alias, email address, mailing address, IP address, and online identifiers. We use this information to respond to new business solicitations regarding our services, to set up and manage accounts, to perform financial advisory and wealth management services, and for targeted marketing services in accordance with our Cookie Policy
  • Certain categories of Personal Information described in subdivision (e) of California Civil Code Section 1798.80, including but not limited to, name, address, telephone number, employment status, and, if you are a Customer, your financial information. We use this information to respond to new business solicitations regarding our services, to set up and manage accounts, to perform financial advisory and wealth management services, and for targeted marketing services in accordance with our Cookie Policy
  • Protected classification characteristics. Mariner does not require you to provide protected classification characteristics but Mariner and the third-party custodian may use this information to perform wealth management and financial advisory services tailored to meet your specific financial and life goals. Specifically, information about your age, marital status, medical condition, and/or physical or mental disability could significantly impact the financial advice that we give to you. However, please carefully consider the information contained within new account applications and advisory agreements to ensure that you are not providing any protected classification characteristics that are not necessary for your specific engagement with us as your advisor. Dependent upon the scope of services, a financial custodian may require certain information from you in order to perform the services (the most common being birth date). Mariner may collect this information on behalf of the custodian. Protected classification characteristics include your age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, genetic information (including familial genetic information), and veteran or military status.
  • Internet or other electronic network activity information, including cookie data and other information on your usage of our website. We use this information to provide targeted advertising based upon your interest in Mariner.
  • Employment-related information including any information provided in a resume/CV or job seeker profile. We use this information for the limited purpose of employment screening and hiring practices. The Mariner Employee & Applicant Privacy Notice and Notice at Point of Collection applies to information we collect, use, share, and retain from prospective, current, and former employees and contingent workers. The Mariner Notice at Point of Collection applies to information we collect, use, share, and retain from prospective, current, and former employees and contingent workers who are California residents.

How We Use Personal Information

With respect to the categories of information set forth above, we use your Personal Information for the following purposes:

Service delivery. We use your Personal Information to:

  • provide, operate and improve the Service;
  • execute your transactions;
  • establish and maintain your user profile on the Service;
  • enable security features of the Service, such as by sending you security codes via email or SMS, and remembering devices from which you have previously logged in;
  • communicate with you or your employer about the Service, including by sending announcements, updates, security alerts, and support and administrative messages;
  • understand your needs and interests, and personalize your experience with the Service and our communications;
  • provide support for the Service; and
  • respond to your requests, questions and feedback.

Research and development. We may use your Personal Information for research and development purposes, including to analyze and improve the Service and our business. As part of these activities, we may create aggregated, de-identified or other anonymous data from Personal Information we collect. We make Personal Information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.

Marketing and advertising. We and our third-party advertising partners may collect and use your Personal Information for marketing and advertising purposes:

  • Direct marketing. We may send you Mariner-related or other direct marketing communications as permitted by law. You may opt out of our marketing communications as described in the Opt out of marketing section below.
  • Interest-based advertising. We may contract with third-party advertising companies and social media companies to display ads on our Service and other sites. These companies may use cookies and similar technologies to try to tailor the ads you see online to your interests based on your activity over time across our Service and other sites, or your interaction with our emails. These ads are known as “interest-based advertisements.” You can learn more about your choices for limiting interest-based advertising, in the Advertising choices section below.

Compliance and operations. We may use your Personal Information to:

  • comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
  • audit our internal processes for compliance with legal and contractual requirements and internal policies;
  • enforce the terms and conditions that govern the Service; and
  • prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

Cookies and similar technologies. The Service employs Cookies and similar technologies to facilitate the purposes for which we use Personal Information:

  • Service delivery and operation. To allow the technical operation of the Service, such as by remembering your selections and preferences as you navigate the site, and whether you are logged in when you visit password-protected areas of the Service, and to enhance the performance and functionality of our services.
  • Interest-based advertising. To facilitate interest-based advertising as described above.
  • Research and development. To help us understand user activity on the Service, including which pages are most and least visited and how visitors move around the Service, as well as user interactions with our emails and advertisements. For example, we use Google Analytics cookies for this purpose. How We Share Your Personal Information

Mariner does not disclose Personal Information to third parties in exchange for monetary compensation. However, as discussed in this Privacy Policy, Mariner does work with advertising partners to collect information about user internet browsing activities to provide those users with more relevant advertising as they browse. This may be considered the “sale” or “sharing” of Personal Information for cross-context behavioral advertising under certain laws.

Otherwise, we may share your Personal Information with the following parties and as otherwise described in this Privacy Policy or at the time of collection:

Affiliates. We may share Personal Information about you with our affiliated companies for everyday business purposes, and we may share this information to market their products or services to you. Additionally, we do not share information with our affiliated companies regarding your creditworthiness.

Service providers. Companies and individuals that provide services on our behalf or help us operate the Service or our business (including but not limited to IT, hosting, investment trading, customer relationship management and support, print and mail fulfillment, data management, event registration, email delivery, marketing, website analytics, and event management services).

Service-related third parties. Brokers, custodians, administrators, investment funds and their respective managers and other non-affiliated third parties as necessary to provide the Service.

Advertising partners. Third party advertising companies that collect information about your activity on the Site and other online services to help us advertise our services, and/or use hashed customer lists that we share with them to deliver ads to them and similar users on their platforms.

Professional advisors. Professional advisors, such as lawyers, auditors and insurers, where necessary in the course of the professional services that they render to us.

Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and operations purposes described above.

Business transferees. Relevant participants in business transactions (or potential transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Mariner or our affiliates (including, in connection with a bankruptcy or similar proceedings).

How Mariner Independent Advisor Network (“MIAN”) and Mariner Platform Solutions (“MPS”) Share Your Personal Information

MIAN and MPS will not share your non-public personal information with a non-affiliate for purposes of the nonaffiliate to market to you, unless your financial advisor leaves the firm, retires or sells his or her practice.

In situations where a financial institution does disclose customer information to nonaffiliates, other than permitted or required by law, customers must be given the opportunity to opt out or prevent such disclosure. As described herein, the firm does not share or disclose current, prospective and/or former clients’ nonpublic, personal information to nonaffiliates except where permitted or required by law.

Your Choices

You have the following choices with respect to your Personal Information.

Updating your information.  If you believe your Personal Information on file with us is inaccurate or incomplete, you can contact us to correct that information.

Opt out of marketing communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. You may continue to receive service-related and other non-marketing emails.

Cookies. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies, the Service may not work properly. For more information about cookies, including how to see what cookies have been set on your browser and how to manage and delete them, visit www.allaboutcookies.org. We use Google Analytics to help us understand user activity on the Service. You can learn more about Google Analytics cookies at https://developers.google.com/analytics/devguides/collection/analyticsjs/cookie-usage and about how Google protects your data at http://www.google.com/analytics/learn/privacy.html. You can prevent the use of Google Analytics relating to your use of our sites by downloading and installing a browser plugin available at https://tools.google.com/dlpage/gaoptout?hl=en.

Advertising choices. You can limit use of your information for interest-based advertising by using appropriate publicly available tools to modify your browser, platform, cookie, and advertising settings. You will need to apply these opt-out settings on each device from which you wish to opt out.

Do Not Track. Some internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

Declining to provide information. We need to collect Personal Information to provide certain services. If you do not provide the information requested, we may not be able to provide those services.

Third-party services. We may give you the option to use third-party services to gather your account data from financial institutions. You are not required to use these services to receive services from us. By using one of these services and allowing it to gather your outside account data, you grant us and the third-party service the right, power, and authority to act on your behalf to access and transmit your personal financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by the third-party service in connection with its privacy policy and terms of use. 

We also may partner with banks to offer certain products and services. If you are approved for a product offered through Mariner by one of our bank partners, or through other partnerships with bank partners, your non-public Personal Information will be subject to their privacy policies.

You should review the privacy polices of any third-party services or bank partners before sharing your Personal Information with them.

Children

Although our services are not targeted to, or intended for use by, children under 16 years of age, we collect certain information from children under the age of 16 when provided to us by their parents, guardians, or other authorized representatives in connection with the provision of financial advice.  If you believe we have collected or otherwise processed information for a child under the age of 16 without authorization, please contact us right away.

How We Manage and Protect Your Personal Information

In order to protect Personal Information, we maintain reasonable physical, electronic and procedural safeguards. Mariner also limits access to Personal Information to individuals who need to know that information in order to service your account and provides training to its employees on proper handling of Personal Information.

Retention of Your Information

Mariner will retain your Personal Information for as long as is necessary to complete the purposes for which it was collected, or as may be required by law.  When we no longer need your Personal Information for our purposes, we will destroy, delete or erase that Personal Information or convert it into an anonymous form.

To the extent our employees or affiliates are providing tax services as certified public accountants, we are governed by professional standards set forth by the American Institute of Certified Public Accountants Ethical Standards and governing state accountancy laws. Information that we receive from you for the specific purposes of receiving tax services provided by Mariner shall be retained and eventually disposed of in accordance with applicable federal and state laws that govern general public accountants.

State-Specific Information

As mentioned above, Mariner is a financial institution subject to GLBA, and much of the Personal Information we collect and process is covered by that law. As a result, many state privacy laws do not apply to that information. This section describes the rights that may apply to Personal Information collected outside the scope of the GLBA, including when you use Mariner’s website or interact with us outside of a financial product or service. Depending where you live, you may have the rights set forth below.

Right to know/access information. You may have the right to request access to Personal Information collected about you and information regarding the source of that information, the purposes for which we collect it, and the third parties and service providers with whom we share it.

Right to correct/rectify inaccurate information. You may have the right to request correction of inaccurate Personal Information that we hold about you under certain circumstances. If you believe your Personal Information on file with us is inaccurate or incomplete, you can contact us to correct that information.

Right to request deletion of information. You may have the right to request deletion of any Personal Information that we have collected from you, subject to legal exceptions.

Right to opt out of sale and sharing. Mariner does not disclose Personal Information to third parties in exchange for monetary compensation. However, as discussed in this Privacy Policy, Mariner does work with advertising partners to collect information about user internet browsing activities to provide those users with more relevant advertising. To the extent this may be considered the “sale” or “sharing” of Personal Information or processing of Personal Information for online targeted advertising under applicable U.S. state laws, you may have the right to opt out of this activity by managing your preferences through the “Your Privacy Choices” link located in the footer of our website.

Right to non-discrimination. Exercise any of the rights listed here without being treated unfairly or denied services.

Right to limit sensitive Personal Information. You may have the right to request that we limit the use or disclosure of certain sensitive Personal Information. This includes information about your financial information to the extent such would enable access to your account.

Right to list of third parties. You may have the right to request a list of the “third parties” (as defined under applicable law) with whom we have disclosed their Personal Information. To request this list, please email us at [email protected] with the subject line “third parties.”

Right to appeal. You may have the right to submit an appeal if we deny a privacy-related request. For instructions on how to file an appeal, please email us at [email protected], with the subject line “Oregon resident appeal,” “Minnesota resident appeal,” or “Montana resident appeal” as applicable.

Verification procedures

In order to process your request, we must verify your request. Depending on the type of request and how you submit your request (e.g., through your account or via email) we do this by:

  • Asking you to provide personal identifiers we can match against information we may have collected from you previously
  • Asking you to confirm your request using the email address or telephone number stated in the request.

If you have authorized someone else to make requests on your behalf (e.g., an authorized agent), we will require that you provide a signed letter confirming the identity and authority of that person. Such signed letters can be submitted by emailing [email protected] with the subject line “authorized third party.”

Changes to this Privacy Policy/Client Notifications

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service. If required by law, we will also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via email or another manner through the Service. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your continued use of the Service after the posting of any modified Privacy Policy indicates your acceptance of the modified Privacy Policy.

We will annually provide a GLBA Privacy Notice to our Customers. In the event of any material changes to our privacy policy, we will provide Customers with notice of such changes.
